These terms govern a gym's use of the gymtech platform. By requesting an account or using the app, the gym agrees to them.
The service
gymtech is a subscription service for running a gym, provided by [Company legal name]. It includes the gym's phone app, the server that stores and syncs the data, and the admin panel our team uses to manage accounts. The plan the gym chooses sets the features and limits available to it.
Your account
- The gymtech team creates the gym's account after it is requested and sends the login to the owner.
- The gym owner is responsible for keeping the login secret, for the accuracy of the data entered, and for their staff and their permissions.
Plans and payment
- Subscriptions are monthly or yearly, priced in US dollars and payable in Syrian pounds at the platform's exchange rate.
- The first invoice is issued when the account is created.
- There is no free trial at the moment.
- If a payment is late, the service enters a grace period and then read-only mode: viewing data and check-ins keep working, and new payments can't be recorded until it is settled. Data is never deleted for late payment.
- Full service returns as soon as payment is made.
Acceptable use
- Only message the gym's registered members; bulk messages to strangers are not allowed.
- Don't enter anyone's data without the right to do so.
- Don't try to access another gym's data or disrupt the service.
Trial WhatsApp sending
Automatic WhatsApp sending is a trial for now: it uses the gym's number through an unofficial service, and WhatsApp may ban the number. Use a number dedicated to the gym, not a personal one. The platform will offer the official paid channel later.
Offline use and sync
The app saves every action on the phone at once and syncs it with the server when the connection is back, and the same action is never applied twice. For anything financial, the server's time is the reference, not the phone's.
Intellectual property
The app, the server, the panel and their design belong to gymtech. The gym's data remains the gym's, and it may export it.
Disclaimer and limitation of liability
We work to keep the service running and take daily backups, but it is provided “as is”, without a guarantee that it is free of faults. We are not liable for indirect damages, or for WhatsApp bans resulting from trial sending, and our liability is in any case limited to what the gym paid in the [three months] before the claim.
Termination and data export
The gym may end its subscription at any time. Before that, the owner can ask for an export of their data; it is then deleted within [30 days], as set out in the privacy policy. We may suspend an account that breaks these terms after notifying the owner.
Changes
We may update these terms, and we tell the gym owner about any significant change before it takes effect.
Governing law
These terms are governed by the laws of [the Syrian Arab Republic].
